Terms of Use
These Terms of Use ("Agreement") govern your use of the software platform ("Platform") provided by Steerly ("Company") for the purpose of facilitating driving lessons between driving instructors ("Instructors") and their students ("Students"). By accessing or using the Platform, you agree to be bound by this Agreement. If you do not agree with any of the terms stated below, you may not use the Platform.
1. Account Registration1.1. Instructors: To use the Platform as an Instructor, you must create an account by providing accurate and complete registration information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.1.2. Students: To use the Platform as a Student, you may be invited by an Instructor or sign up directly by providing accurate and complete registration information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
2. Platform Services2.1. Instructor Services: The Platform allows Instructors to create profiles, manage their availability, schedule driving lessons, and interact with Students.2.2. Student Services: The Platform allows Students to sign up with Instructors, request driving lessons, schedule lessons based on Instructor availability, and make payments for driving lessons.
3. Use of the Platform3.1. Eligibility: You represent and warrant that you are at least 18 years old and have the legal capacity to enter into this Agreement.3.2. Compliance: You agree to use the Platform in compliance with all applicable laws and regulations. You further agree not to use the Platform for any unlawful or unauthorized purpose, or to engage in any activity that may harm the Platform or its users.3.3. Account Information: You agree to provide accurate and complete information when creating your account and to promptly update any information that may change. You acknowledge that the Company may rely on the information provided to contact you and provide services.3.4. Account Security: You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify the Company immediately of any unauthorized use of your account or any other breach of security.3.5. Prohibited Activities: You agree not to: Use the Platform to harass, defame, stalk, threaten, or otherwise violate the rights of others.
4. Territory Limitation4.1. Geographical Scope: The Platform is intended for use only by driving instructors based in the United Kingdom ("UK"). By accessing and using the Platform, you confirm that you are a UK driving instructor and will use the Platform solely for the purpose of providing driving lessons within the UK.4.2. Use of VPNs: You agree not to use any virtual private network ("VPN") or other means to circumvent the geographical scope of the Platform.4.3. Account Verification: The Company reserves the right to verify the credentials and eligibility of Instructors to ensure compliance with the geographical scope mentioned above. Instructors may be required to provide supporting documentation or information upon request.
5. Payments5.1. Pricing: Instructors shall determine the fees for their driving lessons, which will be displayed to their students. Students agree to pay the specified fees for the requested lessons.5.4. Refunds: Students or Instructors are expected to resolve any refund disputes directly with each other. The Company is not responsible for any refund-related issues arising from your use of the Platform as it does not process any payments.
6. Content Ownership6.1. Platform Content: The Platform may include various forms of content, such as text, graphics, images, videos, and other materials. All content provided through the Platform is owned by the Company or its licensors and is protected by intellectual property laws.6.2. User-Generated Content: Instructors and Students may contribute content to the Platform, including reviews, comments, and messages. By providing such content, you grant the Company a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and display the content for the purposes of operating and promoting the Platform.
7. Privacy7.1. Data Collection and Use: The Company collects and uses personal information in accordance with its Privacy Policy. By using the Platform, you consent to the collection, storage, and processing of your personal information as outlined in the Privacy Policy. 7.2. Communication: By using the Platform, you agree to receive communications from the Company, including service-related notifications and updates. 8. Termination8.1. Termination by Users: You may terminate your account at any time by contacting the Company. Termination will result in the deletion of your account and any associated data, except as otherwise provided by applicable law or the Company's Privacy Policy.8.2. Termination by the Company: The Company reserves the right to suspend or terminate your access to the Platform, in whole or in part, at its sole discretion, with or without notice, for any reason, including but not limited to violation of this Agreement or applicable laws.
9. Disclaimer of Warranties and Limitation of Liability9.1. Disclaimer: The Platform is provided on an "as-is" basis, without any warranties or representations, whether express or implied. The Company disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.9.2. Limitation of Liability: The Company shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, or other intangible losses, arising out of or in connection with the use or inability to use the Platform.
10. Governing Law and Dispute Resolution10.1. Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflict of laws principles.10.2. Dispute Resolution: Any disputes arising out of or in connection with this Agreement shall be resolved through good-faith negotiations. If the parties fail to reach a resolution, any such disputes shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.
11. Amendments11.1. Modifications: The Company reserves the right to modify, update, or change this Agreement at any time. Changes will be effective upon posting of the revised Agreement on the Platform. Your continued use of the Platform after the posting of any changes constitutes acceptance of those changes.
